MINUTES January 29, 1998 3 BOARD OF HEALTH <br /> Mr. McQuaid stated, "Recently, we received a complaint from a fired employee of <br /> Chaudrey's on Route 28." "That person indicated there were a lot of food violations that <br /> Mr. Evans eventually resolved with the owners." "She also complained about the fact that <br /> the employee's were smoking behind the counter, particularly on the evening shift." "This <br /> lady, probably looking for reasons to get them in trouble, stated that she would verify and <br /> testify in court that she has seen employee's in Chaudrey's sell cigarettes to minors on <br /> more than four occasions." "I contacted Mr. Collette, who indicated to me that this very <br /> same company has had violations in Falmouth and Hyannis." "There is a State law that <br /> you can't sell cigarettes to minors." "Several towns have adopted a tobacco license to sell <br /> cigarettes." <br /> Mr. Collette stated, "We did a sting at Chaudrey's in October and they were the <br /> only business in town that sold cigarettes to minors." "We had a 15 year old female go <br /> into the store and ask for a pack of Marlboro's." "The women behind the counter said, <br /> "Just make it fast" so the girl came out and informed me of what transpired." "This brings <br /> to mind the point that Mr. McQuaid made about being permitted to sell tobacco <br /> products." "The town of Harwich just implemented a tobacco license." "The license fee <br /> could be very minimal." "The idea is so that the Board of Health has some way to <br /> monitor or to punish repeat offenders." "What has happened in the past is people who <br /> have been caught the first time are given a formal written warning from the Board of <br /> Health." "The Board of Health has within its authority defined any person or retailer who <br /> sells cigarettes $100.00 for the first offense, $200.00 for the second offense and $300.00 <br /> for each additional offense or you can pull their license." <br /> Mr. McQuaid requested Mr. Collette provide the Board with a copy of legal <br /> penalty provisions and other towns cigarette regulations. <br /> 5.) Warrant article for septic repair program - Mr. McQuaid will prepare a draft <br /> article for next week's meeting. <br /> 6.) Emergency Repair Certification 26 Sand Dollar Lane - Mr. Evans relayed, "I <br /> inspected the site and found the leach pit overflowing onto the ground surface." <br /> Board members forwarded their signature's to the "Emergency Repair <br /> Certification"form. <br />
