MINUTES March 17, 1999 5 BOARD OF HEALTH <br /> permits have expired and forcing you to expend additional funds in order to re- <br /> design them, especially if nothing is going to change. I don't believe anything <br /> substantial has changed. The basis for my opinion is that you've been, in good <br /> faith, actively working on it and that some delays came up that were <br /> unforeseeable and I'm not going to penalize you for that." <br /> Mr. Cram stated, "In looking at the footnote at the bottom of the application, it <br /> says that we must wait for proof of tax payments. Has that been satisfied?" <br /> Mr. Grotzke responded, "Yes, since Icahn took over he paid all of the income <br /> taxes to the town. All of the company's taxes have been paid." <br /> Mr. Cram stated, "Well need proof of that." <br /> Mr. Grotzke added, "Okay. We had done the peres on these between March <br /> 14-28, 1998. It was before then that we had sent our contractor in to pull the <br /> permit and I sent him in with the check for $1400. That was when, during <br /> Elias'review prior to signing off, he determined that there were some <br /> discrepancies in the septic system design. At that time we entered into a <br /> dialogue and Elias said we could have some more time. We had that resolved <br /> and the contractor came in and signed for the permits and that was where there <br /> was no check associated with those permits. I confirmed that with the <br /> contractor. He didn't pay for the permits." <br /> Mr. McQuaid stated, "On March 19, 1998 we granted a 60-day extension on <br /> the perc tests from that date. Which means that everything would stay valid, <br /> but the permits would have had to be issued within those 60 days. The permits <br /> were signed for by the installer, but never paid for. Therefore, none of the <br /> permits have actually been issued. I hear what Mr. Doherty is saying and I'm <br /> certainly not going to object to what the Board decides to do. I think this is at <br /> the end of a long struggle and let's just get the check in and issue the permits. <br /> Otherwise he's going to have to start from scratch which means a whole new <br /> design." <br /> Mr. Doherty motioned to grant a 30-day extension of the perc tests on the <br /> following lots: 55 Uncle Edward's Road, 3, 4, 6, 7, 10, 14, 15, 16, and 20 Aunt <br /> Jane's Road, pending receipt of the required fees due. Mr. Ball seconded the <br /> motion, all agreed. <br /> Mr. Grotzke then asked the Board for a few minutes of their time for a discussion of <br /> preliminary plans regarding the Popponesset Inn. <br /> Mr. Grozke informed the Board members of the current status of the <br /> Popponesset Inn. <br /> Mr. Cram expressed his concern with the revision of the plans since the Board <br /> last met to review the project. <br /> Mr. McQuaid express concern regarding using the existing leaching facility <br /> since it is known to be not working properly. <br />
