MINUTES April 27, 2000 2 Board of Health
39 Timberlane Drive Variance Request
Mr. McQuaid received a variance request today for repairs to the septic system at 39 Timberlane
Drive.
Ms. Warden made a site visit and explained the lot is very small, 100 x 100, with a steep grade.
The residents have been without water for 3 weeks because they cannot use the leaching fields.
The only thing possible is for the homeowners to rebuild the system in the same location; there
are no other alternatives.
The variance request is for 92 feet from 100. Mr. Doherty noted the requirement is 150 feet, not
100, as requested.
Mr. Doherty made a motion to approve the variance request for 39 Timberline Drive from the
setback requirement of 10 feet to 2 feet and for separation distance variance from 100 feet
(requirement is 150)to 91 feet upon submission of a revised letter with correct numbers. Mr.
Cram seconded the motion. All members were in favor 3-0.
8 Jones Road Variance Request
Mr. McQuaid explained this is new construction with a de-nite system. They are requesting a
variance from 150 foot setback to 123 feet.
The applicant must submit revised plans that include a locus.
Mr. Doherty made a motion to approve the variance request for 8 Jones Road subject to revised
plans with addition of a locus. Mr. Cram seconded the motion. All member were in favor 3-0.
Sea Mist Resort Request
Mr. Elias explained this request was faxed to the office today. Sea Mist Resort is requesting
their trash be considered residential rather than commercial and be charged accordingly.
Mr. Cram asked if the Board of Health can make this decision since the Board of Selectmen are
scheduled to take over the transfer station?
Mr. Doherty noted this trash will not pass through the transfer station. The Board of Health is
just declaring a category to determine what rate is charged.
The Board of Health has previously decided that motels be left in the commercial category.
Mr. Doherty made a motion to deny the request of Seat Mist to be considered residential trash in
order to be consistent with their decisions in the past regarding this issue. Mr. Cram seconded
the motion. All members were in favor 3-0.
7:15 Appointment with Maryann Ingala
No one was present representing Ms. Ingala.
7:30 Appointment with Tom Smith/Ed Pesce 266 Monomoscoy Road
Mr. Pesce was present representing Mr. Smith.
Board members previously received a report from P.
