MINUTES June 1, 2000 8 BOARD OF HEALTH <br /> Mr. Bliss asked, "Is there anything in the minutes that says Life at Mashpee was <br /> looking for something extra which would have allowed to have it fall in place with 99 <br /> and Cookes?" <br /> Mr. Eichner questioned, "Looking for something extra..." <br /> Mr. Bliss clarified, "Asking for anything that would have put them into the same road <br /> as Cookes?" <br /> Mr. Ball stated, "We didn't get that far." <br /> Mr. Eichner stated, "Let me just read to you "Mr. Ball motioned to approve sign-off on <br /> a building permit with the stipulation DEP approved connection to the Talanian <br /> treatment plant, however, should Talanian fail to develop the proposed system or the <br /> timing of the project to the completion of the Talanian system does not fall in line, <br /> developer of Life shall comply with all Town and State septic system requirements and, <br /> due to the close proximity to the Mashpee River, shall include the installation of a <br /> denitrification unit. Mr. Cram seconded." <br /> Mr. Bliss asked, "What was the date of that please?" <br /> Mr. Eichner responded, "That was November 19, 1998." <br /> Mr. Bliss stated, "Again, I would say that they may have said that but they didn't have <br /> the power to enforce that. I mean, if an applicant put that condition, he would be <br /> volunteering it. He's not required to do it. It would be the same as if he stood up and <br /> said that he'd like to make this additional thing because I think it's good for the <br /> environment." <br /> Mr. Mahoney added, "You do realize that we had permits. Title V permits purchased <br /> and on record. Do you know that? If you don't, III provide them for you. I have one <br /> per building as proposed by Steve Haas, our engineer." <br /> Mr. Eichner stated, "I thought those were after that." <br /> Mr. Bliss stated, "This is November of '98." <br /> Mr. Mahoney stated, "I'd have to look at the date, but just so that you are aware, we <br /> were permitted, purchased and permitted approved plans by this town." <br /> Mr. Bliss stated, "The permits were in February of '99." <br /> Mr. Mahoney stated, "Those were obtained through our legal which is Kevin Kirrane <br /> and they are engineered by Steve Haas. I know that the only issue in my mind, two <br /> issues is, one with Brian because of some co-ownership we were very uncertain <br /> whether or not that would happen and whether or not the Cape Cod Commission <br /> would grant. And we do appreciate it, this is not an attack, believe me, on the Cape <br /> Cod Commission. Whether or not they would grant us, us meaning Talanian and the <br /> Life project, in early phase 1, and you did and we appreciate it. All I'm here to clear <br /> up is to make everyone understand. I believe the Board does understand." <br />
