MINUTES June 1, 2000 9 BOARD OF HEALTH <br /> Mr. Ball stated, "Ed, what is your question? What do you need from us?" <br /> Mr. Eichner stated, "I think I have already asked my question which was, if the <br /> Talanian project doesn't go forward, what the expectations would be for Life at <br /> Mashpee? What I really wanted to achieve at this meeting was to get everybody <br /> together in one room so we don't have to worry about letters going back and forth and <br /> get everything clear and out on the table." <br /> Mr. Ball stated, "I don't believe we have to vote. I believe our position is clear." <br /> Mr. Bliss questioned, "I guess I'd like to ask and maybe you... are you satisfied that <br /> the legal requirement was what it was and that..." <br /> Mr. Eichner interjected, "I am satisfied that the requirement is what it is." <br /> Mr. Bliss questioned, "And you are satisfied that they got Title V permits and that their <br /> intention was to do a standard Title V?" <br /> Mr. Eichner responded, "I am satisfied that they have permits and I have got a clear <br /> understanding of what the regulations are. I'm fairly clear and I think I've been fairly <br /> clear from the beginning of this. It's going to be a questions of, admittedly, of how it <br /> goes during the public hearings and what the Commission ultimately decides. I'm <br /> going to relay the information as was requested about what happened at this meeting <br /> and what's out there and what's been spoken and what's been said." <br /> Mr. Bliss stated, "If it was an existing facility, if Life had built their Title V systems and <br /> Talanian come along and said, look we've got something better, and then we wouldn't <br /> be having this discussion, right? If they updated an existing system, there's no <br /> question about whether they are entitled to a credit." <br /> Mr. Eichner responded, "Right. They have to, in order to get their project approved <br /> under our regulations, they have to meet the no-nitrogen loading requirement." <br /> Mr. Bliss continued, "Right, exactly. What I'm saying is that if they went to an existing <br /> facility and said, we're going to upgrade you, we're going to reduce your nitrogen <br /> output this amount, there's no question they'd get a credit, right?" <br /> Mr. Eichner responded, "Correct." <br /> Mr. Bliss continued, "The only reason we're having a question here is because Life <br /> wasn't built yet, right?" <br /> Mr. Eichner responded, "Right." <br /> Mr. Bliss continued, "The point is that everything was there, ready to go. They had <br /> their permits, there is no difference. There's no difference between Title V system <br /> being in the ground or having their permits. All they had to do was to have a <br /> contractor walk in and construct it. They were completely legally entitled. There were <br /> no strings, there were no conditions. There was nothing else.
