5 <br /> lot. <br /> Mr. Ball stated that he didn't have a problem granting this request. However, the <br /> approval would be based on the following conditions. First the bathroom would <br /> stay downstairs in the garage, the three or four foot knee wall stays as open space <br /> and the homeowner signs an affidavit that it will not turn into another bedroom. <br /> Eventually there will be deed restrictions. But, at this point in time he is satisfied <br /> with what the homeowner is proposing. <br /> Mr. Santos stated that this was done in an effort stem the creative bedroom <br /> construction. The BOH is trying to be fair and consistent. <br /> Ms. Warden stated that signing the building permit would be the last task. <br /> Mr. Santos asked one final question. Would the homeowner be able to tie into the <br /> septic system without too many problems? <br /> Mr. Porter stated that the seller put two 500-gallon holding tanks. Therefore, there <br /> shouldn't be any problems. <br /> Mr. Ball made a motion to grant the request with the above noted conditions. Mr. <br /> Santos seconded it. Motion to grant passed. <br /> 5. Variance request: 112 Waterway <br /> The applicant is requesting that the reserve area be 3' off the street property line. <br /> (10' is required.) The reserve area will be 7' off the side property line. (10' is <br /> required.) They are also making a request for the installation of a denitrification <br /> unit. <br /> Mr. Ball stated that they met the BOH's request from last week of an installation <br /> of a denitrification unit. He motioned to grant the variance requested. <br /> Mr. Santos stated that this was not a revision of a prior request but a new one. <br /> Ms. Warden stated that this request maybe a Conservation Commission <br /> requirement. There is 121' from the coastal bank to the SAS. <br /> Mr. Santos asked if this was a repair? <br /> Ms. Warden stated that there was nothing in the file to suggest that the system is <br /> in failure. The perk was done on July 30th, 2001. <br /> Mr. Santos stated that the engineered plans stated "proposed house <br /> reconstruction." He further stated that if they are doing a total reconstruction. <br /> There should be abutting property owner notification. <br /> Ms. Warden stated that John Slavinsky was making an issue about the "reserve". <br /> Town by-laws doesn't say that you have to notify the abutters of the reserve area. <br /> Mr. Slavinsky could put the reserve in the same location as the proposed system. <br />
