7 <br /> Ian agrees that is likely but we will get a better job out of it. <br /> Bill Hauck suggested they target a portion of the school to be turned over. <br /> You still get quality and satisfy our needs for a few months . <br /> Paul said another problem is the sewage treatment plant, nothing is <br /> happening. <br /> Joel sid they are targeting a testing date in June, plant should be <br /> complete in May. There appears to be sufficient time <br /> Y PP to hook it up and <br /> test it . <br /> Peter said the idea of targeting an area, the academic wing, was what Stone <br /> was working towards, but they are not yet working in the mechanical and <br /> electrical rooms, the roof is not on that area and it is not heated. <br /> Paul has a letter from Griffin Electric, dated Jan. 30th, stating their <br /> concerns about time remaining for them to complete their work. <br /> Janice asked if Town Counsel has given any advice on this matter? <br /> Paul said town counsel thinks the town has a good case to declare Stone in <br /> default, based on correspondence to date. A representative from Koppelman <br /> and Paige will be at tonight ' s Selectmen' s meeting. <br /> Steve said the issue now is how much we want Stone on the job ( after <br /> Liberty takes over) . If the subcontractors causing the deficiencies are <br /> left on the job we don't get anywhere . <br /> Ian asked if the bonding co . takes over, will they call the shots, not us <br /> ( regarding Stone 's Participation)? <br /> Paul said the town has the option to keep Stone, if we- desire. It is not <br /> the bonding companies option. The town has to give permission. <br /> Bob Whritenour explained the town can declare Stone in default and they <br /> have 7 days to respond (to clear the default ) . After those 7 days the town <br /> terminates their contract with Stone, and the town' s relationship with them <br /> is severed. Then the surety company has the option to: <br /> A. with the town' s permission, continue to use Stone and their <br /> subcontractors. <br /> B. do their own negotiated bid for another contractor. <br /> There are additional requirements for revoking the bond. <br /> Bill asked if work will come to a stop during this time? <br /> Work could come .to a stop. <br /> Paul said if the town allows them to leave Stone on the job, it could save <br /> them time, trouble and money. <br /> He said Stone is prepared to immediately bring this to arbitration but town <br /> counsel does not think they have a case. <br /> Bob Whritenour said the arbitration provision is not in effect under this <br /> contract. If Stone could get an injunction against us , they would need to <br /> get the town' s assent to go to arbitration. <br /> ** Steve made a motion that the High School Building Committee <br /> recommend to the Selectmen they declare Stone Building Company in <br /> default of their contract because of non performance .
