SECTION IV <br /> RECORDS, SPECIAL EDUCATION, LAWS,RETENTION <br /> RECORDS (ACCESS TO) <br /> SUMMARY OF REGULATIONS PERTAINING TO STUDENT RECORDS <br /> The State Board of Education has adopted Regulations Pertaining to Records. The <br /> development of these regulations, which have the force of law, was mandated by state laws <br /> enacted in 1972 and 1974. The regulations apply to all public elementary and secondary <br /> schools. They are designed to insure parent/guardian and student rights of confidentiality, <br /> inspection, amendments, and description of responsibilities for the maintenance of student <br /> records. <br /> Note: Access to student records pursuant to General Law, Chapter 71, Section 340. <br /> "Records shall be given to all parents, legal guardians and students of a certain age, <br /> upon request via the child's guidance counselor. Interpretation of said records will <br /> be provided with appropriate notice." <br /> STUDENT RECORDS <br /> A student's record must be made available to the student and/or his or her parent/guardian <br /> within two consecutive weekdays after an initial request to the principal of the school. <br /> By decision of the Mashpee School Committee, copies of the records shall be furnished <br /> upon request, for a fee of S.20 per page. This rate is equivalent to the cost of reproduction. <br /> A professionally qualified staff person shall be available, upon request, to interpret any of <br /> the contents of the record. In addition, the eligible student and/or his or her parent/guardian <br /> may have the student record inspected or interpreted by a third party of their choice upon <br /> due written consent of the eligible student or parent/guardian. <br /> A school may release a student's name, class,participation in officially recognized activities <br /> and sports, honors and awards, and post high school plans without the consent of the student <br /> or parent/guardian unless the school is informed in writing that such information shall not be <br /> released. <br /> Otherwise, no information in a student's record shall be given to a third party without the <br /> specific written consent of the student and/or his or her parent/guardian, except upon the <br /> receipt of a court order or lawfully issued subpoena, or when given anonymously in <br /> statistical form to the Department of Education or independent researchers, or as requested <br /> by the representatives of the Department of Education acting for the Commissioner in <br /> connection with the enforcement of federal and state education laws, or when forwarded to <br /> the school to which a student is transferring unless the student or parent/guardian requests <br /> that such information not be transferred. , <br /> 33 <br />
