SECTION 3: FAILURE TO OBSERVE TIME LIMITS <br /> In the event the grievant fails to exhaust its remedies under grievance procedures provided <br /> above, or to abide by the time limits with respect to each step, the grievance shall be <br /> presumed to be abandoned and the matter shall be settled in accordance with the School <br /> Department's last answer thereto. In the event the School Department fails to give its <br /> answer at any step within the time limits prescribed, the grievant shall have the right to <br /> proceed immediately to the next step. Any time limit may be extended by written mutual <br /> agreement of the grievant and the School Department. <br /> SECTION 4: EFFECT OF SETTLEMENT <br /> Any settlement of a grievance shall be applicable to that grievance only and shall not be <br /> binding authority for the disposition or any other grievance. Any grievance initiated under <br /> this procedure shall be brought by and for the student or employee alleging action in <br /> violation of Title IX and the implementing regulations by the School Department, affecting <br /> the student or employee initiating the grievance. <br /> N.B. GRIEVANCE FORMS RELATING TO THIS PROCEDURE ARE AVAILABLE <br /> AT THE SUPERINTENDENT'S OFFICE. <br /> RETENTION POLICY <br /> • All cases regarding possible retention of a student in grades K-2 will be referred to <br /> the Teacher Assistance Team (TAT). The ultimate decision will rest with the <br /> Principal after consultation with the team. <br /> • Referral for retention may be made by classroom teachers, school administrators or <br /> parents/guardians. A child considered for retention must be reviewed by the TAT, <br /> which includes the child's regular classroom teacher and any specialists working <br /> with that child. The TAT would then decide if further referral shall be made. <br /> • The following conditions may warrant consideration for retention: <br /> • Failure of two or more terms in any two academic subjects <br /> • Absence from any class in excess of thirty(30) days <br /> • Retention will be considered only after all other possibilities have been <br /> exhausted, including special support and remediation efforts. <br /> • The Superintendent of Schools shall approve a second retention assigned <br /> any students. <br /> • Parents/guardians must be contacted as soon as it is determined that school <br /> retention is a possibility. <br /> • Parents/guardians will be required to sign off regarding their decision to <br /> promote a child when the administrator has determined retention is necessary. If the <br /> parent/guardian does not sign off, the child will be retained as decided by the School <br /> Team. <br /> 39 <br />
