To see if the Town will vote to amend the Town By-Laws., <br /> as amended, by deleting Paragraph (d) and (c) of Section ¢.10.6 and <br /> insert in their place the following: r '$ <br /> (d) -The Selectmen shall, Thereafter, hold a public hearing on the <br /> Petition for Acceptance of the private way. Notice shall be given <br /> of such hearing by publication in a newspaper of general circulation "' ' <br /> in the Town at least seven days prior to the date assigned for the <br /> hearing and said notice shall identifythe <br /> private way and the " <br /> Proposed acceptance. At this hearing the Selectmen shall inform ' <br /> those in attendance of the total estimated cost to be borne by the <br /> ab +uting property owners and owners of property deemed to be ben- <br /> efited by the acceptance and improvements; and, <br /> (e) Upon receipt of the written approval of those property owners <br /> bearing 5090 or more of the estimated cost, the Selectmen shall <br /> proceed to layout the way and upon completion of the layout <br /> shall cause an appropriate Article to be inserted in the next <br /> Annual Town Meeting, the proposed work to construct, reconstruct, <br /> or repair the private way, shall be put out to public bid and <br /> within six months following the completion of the work the <br /> total cost shall be apportioned by the Selectmen, with the f <br /> assistance of the Town Engineer and the Board of Assessors, <br /> to the owners of the land abutting the way and to any other owners ' ' <br /> of land deemed to be benefited, and betterments shall be assessed <br /> to them in accordance with the provisions of the General Laws of <br /> the Commonwealth, or take any related action thereon. <br /> ACTION: Moved and seconded that Article 37 be accepted as printed <br /> Motion carried Passed unanimously. <br /> i <br /> II <br /> i <br />
