<br /> To see if the Town will vote to delete Article 4.3 Rules and Regulations Regarding Wetlands
<br /> of the Town By-laws and insert a new Article 4.3, entitled "Wetlands Protection" as follows:
<br /> ARTICLE 4.3 WETLANDS PROTECTION
<br /> Section 4.3.1 Purpose
<br /> The purpose of this bylaw is to protect the wetlands, related water reso.gces, an!
<br /> a io r-
<br /> d ining land areas in this municipality by prior review and control of activities deemed
<br /> by the Conservation Commission likely to have significant or cumulative effect upon
<br /> wetland values, including but not limited to the following: public or private water sup-
<br /> ply, groundwater, flood control. erosion and sedimentation control. storm damage
<br /> prevention, water pollution, fisheries, shellfish, wildlife habitat, recreation,,,_�_ 7..- ;
<br /> agriculture, and aquacultural values (collectively, "the wetland values protected by this
<br /> bylaw").
<br /> Section 4.3.2 jurisdiction
<br /> Except as permitted by the Conservation Commission or as provided in this bylaw, no
<br /> person shall remove, fill, dredge, build upon, or alter land within 100 feet of the following
<br /> resource areas: freshwater wetland, coastal wetland, marsh, wet meadow, bog, or swamp-
<br /> bank, beach, dune or flat; river, pond, stream, estuary, or the ocean; and land under said
<br /> waters: or any land subject to flooding or inundation by groundwater, surface water. tidal
<br /> action, or coastal flowage.
<br /> Section 4.3.3. Exceptions
<br /> The permit and application required by this bylaw shall not be required for
<br /> maintaining, repairing, or replacing, but not substantially changing or enlarging, an existing,
<br /> and lawfully located structure or facility used in the service of the public to provide eleclric.
<br /> gas, water, telephone, telegraph or other communication set-vices, provided that written
<br /> notice has been given to the Commission prior to commencement of work, and provided that
<br /> the work conforms to performance 5tandards in regulations adopted by the Commission.
<br /> The permit and application required by this !:�% n1_W.i;hall not be required for uurk perforn-ed for
<br /> normal maintenance or umrovement of land in a '��icultural use or in aquacultural use, provider-
<br /> that written notice has been given to the CcrLiTL-ssicn prior to the application of any
<br /> agricultural chenuca-1, and provided that the -vi,)rk conforms to the perfornance standards m
<br /> regulations adopted �:y the ConTaission.
