Article 9 <br /> To see if the Town will vote to amend Article 4.7 of the Town By-Laws by adding the <br /> following new section: <br /> Section 4.7.5.2 Houseboats <br /> a. For the purpose of this by-law the word Houseboat is defined as a watercraft structure, <br /> including any type of structure permanently or temporarily placed on a float, raft, barge or <br /> other floating vessel or structure, designed primarily as living quarters and is not primarily a <br /> self-propelled sea going vessel. <br /> b. No person shall moor a houseboat in the waters of Mashpee except at a pier, slip, or dock <br /> without the express prior approval of the Harbormaster. <br /> c. No person shall use or occupy or permit the use or occupancy of a houseboat for living <br /> quarters either permanently or on a temporary basis on the waters of Mashpee except <br /> pursuant to a permit issued by the Board of Selectmen and unless such houseboat and its <br /> proposed mooring location meet the following requirements. <br /> 1. There is provided within the houseboat not less than 600 square feet of living area. <br /> 2. The houseboat is designed and maintained so that there is no opening below the water <br /> lime for water or sewage removal. <br /> 3. The houseboat is designed and constructed so that all waste and sewage is self- <br /> contained on board and has a facility for the pumping or removal of such waste or <br /> sewage. <br />` 4. The houseboat is designed and constructed so that it meets the requirements of the State <br /> Building Code,including specialized codes thereof, except insofar as the provisions <br /> thereof are not reasonably applicable. <br /> 5. There is available to the houseboat a permanent water supply with an individual anti- <br /> backflow valve, a permanent supply of electricity, and sewage/waste removal facilities <br /> and discharge in compliance with all applicable Federal, State, and Town health laws. <br /> d. The Board of Selectmen may limit the term of such permit and may propose additional <br /> conditions on such permit deemed necessary by it to protect the public health,welfare,safety <br /> and to promote the general welfare. <br /> e. The Board of Selectmen may revoke any permit for a houseboat for violation of any of the <br /> provisions of this By-Law or the permit after written notice to the permit holder and an <br /> opportunity to be heard before the Board. Such written notice shall be delivered to the <br /> houseboat and shall state the date and time the Board will consider the proposed revocation. <br /> Motion to accept as amended. . . . motion carries. . . . . . . .8:00 P.M. <br />
