in Mashpee, Massachusetts," dated December 5, 1994 and prepared by BSS Design, Inc., which
lies within the following boundaries:
Beginning at the northeasternmost corner of said parcel, thence westerly 500 feet
along the southern sideline of the Nathan B. Ellis Highway (Route 15 1) to a point,
thence southerly in a straight line to a point on the northerly sideline of a
Commonwealth Electric Company power line easement lying 500 feet westerly of the
center of the Quashnet River, thence westerly along the northerly sideline of said
easement to the westerly boundary of the parcel, thence southerly, easterly and
northerly by the westerly southerly and easterly boundaries of said parcel to the point
of beginning,
and furthermore to authorize the Selectmen to enter into any agreements and execute any and all
instruments as may be necessary on behalf of the town to effectuate said grant, or take any other
action relating thereto.
Submitted by the Board of Selectmen
Explanation: This article would authorize the Board of Selectmen to grant a Conservation
Restriction to the U. S. Fish and Wildlife Service on certain portions of the new high school site
which lie along the Quashnet River and south of, and including, a Commonwealth Electric
power line easement. The Restriction will not affect any of the land proposed to be used for
school facilities, including future expansion areas. It is proposed by the Selectmen in order to
provide the Fish & Wildlife Service with a legal interest in a parcel of land, which is required
before they can begin formal operations of the proposed National Wildlife Refuge. The land
would continue to be owned and managed by the Town.
Recommendation: The Finance Committee recommends approval.
r
Motion made by Selectman Dinizio.
I move Article 24 be voted as printed in the warrant except for the phrase, "or take any other
action relating thereto." •
Motion passes unanimously at 9:15 p.m.
Article 25.
To see if the Town will vote to accept, pursuant to G.L. C. 82, §21-24, the relocation and
alteration of the layout of Great Oak Road as a public way as shown on a plan entitled "Roadway
Easement Plan of Land, Mashpee, Massachusetts", prepared by Bostwick Engineering, Inc.,
dated June 15, 1994 which layout shall have been filed in the office of the Town Clerk not later
than seven days prior to the date of the vote hereunder, and to authorize the Board of Selectmen
to acquire by gift, purchase or eminent domain taking any land necessary for the purposes of
such way as so relocated and altered, and to raise and appropriate, transfer from available funds
or borrow a sum or sums for such purchase or taking and for constructing or reconstructing such
public way, or take any other action relating thereto.
