To: Town Clerk; Deborah Dami <br /> From: Planning Board <br /> Date: October 16th, 2006 <br /> Subject: Votes of the Planning Board on Zoning amendment articles <br /> At their public hearing on September 20th, 2006, the Mashpee Planning Board voted as <br /> follows on the zoning articles appearing on the warrant for the October Annual Town <br /> Meeting: <br /> 1. Article 22, submitted by the Planning Board <br /> Refers to: Amending Section 174-21 of the Zoning By-law. This article would <br /> "grandfather" lots previously approved by the Planning Board for which <br /> subdivision streets were completed within 8 years of signature of the subdivision <br /> plan by the Board, and which became separately woned from all the adjacent land <br /> within that 8 year period. It would make certain lots buildable that otherwise could <br /> not be built on ore would require variances from the Zoning Board of Appeals. <br /> Voted 5-0 no recommendation. <br /> 2. Article 23, submitted by the Planning Board <br /> Refers to: Amending Section 174-21 by adding a new Subsection D. of the Zoning <br /> By-law as follows: "D. Building lots in cluster subdivisions created under previous <br /> provisions of the Mashpee Zoning By-law not requiring a special permit may be <br /> developed pursuant to the lot size, frontage and setback regulations applicable to the <br /> original approval of said subdivision, but subject to any other currently applicable <br /> provisions of this by-law." <br /> Voted 5-0 to recommend approval. <br /> 3. Article 24, submitted by the Planning Board <br /> Refers to: Amending Sections 174-21.1 of the Zoning By-law as follows: Renumber <br /> said Section to become Section 174-27.2. Replace the first four sentences of <br /> Subsection B.(2).This article is intended to update the stormwater management by- <br /> law adopted in 1999 by specifying additional practices and facilities which have not <br /> proven effective in reducing nitrogen in runoff, deleting reference to certain <br /> facilities which have not proven effective and providing additional design guidance <br /> regarding volume of flows required to be treated. The article also renumbers the <br /> section to move it to a more appropriate section of the zoning by-law. <br /> Voted 5-0 to recommend approval. <br /> 4.
