An article submitted by the Planning Board amending Section 174-27, regarding water <br /> quality reports, to reflect updated watershed mapping, target nitrogen loads, standards and <br /> specifications developed as part of the Massachusetts Estuaries Project and other recent <br /> studies. <br /> 7. An article submitted by the Planning Board amending footnote 14 of the Section 174-31 <br /> Land Space Requirements Table to allow the required 10 foot wide perimeter buffer to be <br /> waived, as part of a special permit decision, where the special permit granting authority <br /> determines that such buffer would be inappropriate for the area and where there is written <br /> agreement to said waiver by the abutting property owner. <br /> 8. An article submitted by the Planning Board amending the Section 174-47 cluster <br /> development regulations by making cluster subdivision mandatory, unless waived by the <br /> Planning Board, specifying the cluster design process, increasing the minimum open space <br /> required from 35% to 50%, allowing agricultural uses within the required open space, <br /> increasing flexibility of sizes and dimensional requirements for cluster building lots, <br /> requiring provision for affordable housing, allowing density bonuses for additional open <br /> space and affordable housing, defining "substantial use" for purposes of grandfathering <br /> cluster subdivision special permits, and otherwise updating or clarifying portions of the <br /> cluster subdivision by-law. <br /> 9. An article submitted by the Planning Board which would amend Sections 174-31 and 174- <br /> 45.3.E.(1) to require that when any structure or portion of a structure is proposed to exceed <br /> forty (40 ) feet in height, construction shall require a.Federal Aviation Administration (FAA) <br /> Determination of No Hazard or evidence of exemption.from the determination process, and <br /> would also amend Section 174-45.C. to eliminate a portion of the NStar Electric power line <br /> easement,which lies within the existing Otis A.N.G.B. Accident Prevention Zone, from the <br /> Wireless Facility Overlay District. <br /> 10. An article submitted by the Planning Board amending Section 174-51.B. to remove the <br /> requirement for a ZBA special permit for signs over.20 sq. ft. in area as part of projects <br /> which already require a Planning Board special permit, and amending Subsection 174-55.C.- <br /> to allow the Planning Board to permit more than one appropriate freestanding sign for <br /> projects that come under their jurisdiction. <br /> The full text of these articles and any associated maps or plans may be reviewed in the office of <br /> the Town Clerk or Town Planner at Mashpee Town Hall. <br /> Submitted by <br /> Beverley A.
