TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> DECISION <br /> Re: Petition of Robert R. NcNutt for a Special Permit <br /> A petition was filed by Robert R. McNutt of Mashpee, Massachusetts <br /> .f for a Special Permit under Section 6.3 - A, of the land Use Regulations for <br /> permission to construct condominiums, on property located on Falmouth Road <br /> Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws, Chapter 40A as amended by Chapter 808 of the Acts of 1975• <br /> Notice was given by publication by publishing in the Falmouth Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee on May 6, 1980 <br /> and May 16, 1980, a copy of which is attached hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, May 26, 1980 at 8:15 p.m. at which time the following members <br /> of the Board of Appeals were present and acting throughout: Raymond G. <br /> Sweeney, Peter L. Langler, Peter Muse. <br /> The Petitioner presented a plan to the Board and indicated the <br /> intensions of the area, number of units, parking facilities, amenities, and <br /> access road. <br /> Upon motion duly made and seconded the Board voted unanimously <br /> to grant the request for a Special Permit as requested. <br /> The Board found that the use of the premises would not be detrimental <br /> to the Town or area by reason of excessive traffic noise, or demand on <br /> community facilities. The Board also established that granting the Permit <br /> would be in the best interest of the community, and would be in harmony <br /> with the general purpose and intent of the ordance or by-law. <br />
