TOWN OF MASHPEE BOARD OF APPEALS DECISION Rei Petition of Christopher C. Cushman for a Special Permit A petition was filed by Christopher C. Cushman, Trustee Shanderwes Trust, of Harwich, Massachusetts requesting a Special Permit under Section 6.3 E-1 and E-9 of the land Use Regulations, for permission to extend retail lumber business to adjoining Lot D (Lot #2) on property located on Route 130, Lot D, Mashpee, Massachusetts. Notice was duly given to abutters in accordance with Massachusetts General Laws, Chapter 40A as amended by Chapter 808 of the Acts of1975. Notice was given by publication by publishing in the Falmouth Enterprise, a newspaper of general circulation in the Town of Mashpee on September 2, 1980 and September 9, 1980, a copy of which is attached hereto and made a part hereof. A public hearing was held on the petition at the Mashpee Town Hall on Wednesday, September 17, 1980 at 8:00 p.m, at which time the following members of the Board of Appeals were present and acting through- out: Robert J. Houle, Michael Makunas, Raymond G. Sweeney. The Petitioner presented plans and pictures of the proposed building, and explained the intension to operate a lumber business on the property. Upon motion duly made and seconded the Board voted unanimously to extend the use as granted by Special Permit on September 5, 1978, relative to Lot 1, as it appears on Plan 39380A as recorded by the Barnstable County Registry of Deeds, and to extend said use to Lot 2 as it appears on Plan 39380A, as filed with the Barnstable County Registry of Deeds. As a condition to the granting of the Special Permit, construction �' of the building will be completed by December 31, 1981.
