BOARD OF APPEALS <br /> DECISION <br /> Rei Petition of Jean P. Canning for a Special Permit <br /> A petition was filed by Jean P. Canning of Falmouth, Massachusetts <br /> requesting a Special Permit under Section 6.3 of the land Use Regulations <br /> and Section 9.3 of the Special Provisions, for permission to erect garden <br /> apartments and attached dwellings on property located on Route 28 (Map 81, <br /> Parcel <br /> 3), Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General laws, Chapter 40A. Notice was also given by publishing in the <br /> Falmouth Enterprise, a newspaper of general circulation in the Town of <br /> Mashpee on June 10, 1980, and June 17, 1980, a copy of which is attached <br /> hereto and made a part hereof. <br /> A public hearing was held on the petition by the Board of <br /> Appeals, at the Ptashpee Town Hall on Wednesday, June 25, 1980 at 8:00 p.m. <br /> A presentation was made to the Board indicating the intention <br /> to construct a multi-family condominium development on the property. <br /> Subsequent to the hearing the Petitioner had several meetings with the <br /> Mashpee Planning Board. <br /> The Board found that the use of the premises would not be <br /> detrimental to the Town or area by reason of, excessive traffic noise or <br /> demand on community facilities. The Board also established that granting <br /> the Permit would be in the best interest of the community, and would be in <br /> harmony with the general purpose and intent of the By-law. <br /> Upon motion duly made and seconded the Board voted unanimously <br /> to grant the request for a Special Permit, and to impose the following <br /> conditions and recommendations: / <br />
