'' -• TOWN OF MASH PEE <br /> BOARD OF APPEALS <br /> DECISION <br /> Res Petition of J.R.U. Realty, Inc. for an extension of a Special Permit <br /> A Petition was filed by J.R.U. Realty, Inc. for an extension and <br /> revision of a Special Permit dated November 26, 1973, pertaining to property <br /> located on Old Barnstable Road, Maskspee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws, Chapter 40A as amended by Chapter 808 of the Acts of 1975. <br /> Notice was given by publication by publishing in the Falmouth Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee on February 5, 1980 <br /> and February 15, 1980, a copy of which Is attached hereto and made a part <br /> hereof. <br /> A public hearing was held on the petition at the Mashpse Town Hall <br /> on Wednesday, 'February 20. 1980, at 8x00 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout+ Michael <br /> Makunas, Chairman, Peter L. Langler, Peter Muse. <br /> The Petitioner explained to the Board that because of the recession <br /> the project started in 1973 was never able to be completed. In addition to <br /> the extension of the Special Permit, the Petitioner requested a revision of <br /> a condition set forth in the decision of 1973, to reads ... permission to <br /> construct no less than fifty-two (52) condominiums, and not more than one <br /> hundred four (104) condominiums in any one year. <br /> The Board found that the use of the premises would not be detrimental <br /> to the Town or area by reason of excessive traffic noise, or demand on <br /> community facilities. The Board also established that granting the extension <br /> of the Permit, would be in the best interest of the community, and would be in <br /> harmony with the general purpose and intent of the ordance or By-law. <br /> f <br />
