TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> TOWN HALL, MASHPEE, MASSACHUSETTS 02649 <br /> PAg DECISION <br /> Res Petition of Frank E. Jansson for a Variance <br /> Case # V-82-4-004 <br /> A Petition was filed by Frank E. Jansson, of Mashpee, <br /> Massachusetts, for a Variance under Section 7.4 of the land Space <br /> Requirements for permission to vary the minimum rear set back <br /> requirments, on property located on Lot #10 Asher's Path, Mashpee, <br /> Massachusetts. <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws, Chapter 40A. Notice was given by <br /> publication in the Falmouth Enterprise, a newspaper of general circulation <br /> in the Town of Mashpee, on March 23, 1982, and March 30, 1982, a copy <br /> of which is attached hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee <br /> Town Hall on Wednesday, April 70 1982 at 8130 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughouti Michael Makunas, Peter Lawrence, Peter Muse. <br /> Mr. Frank Jansson made the presentation to the Board <br /> explaining his intention to construct a deck seven and one-half feet <br /> from the rear lot line. <br /> Upon motion duly made and seconded the Board voted <br /> unanimously to grant the request for a Variance as requested by the <br /> Petitioner. <br /> The Board found that the Petitioner established, to the <br /> satisfaction of the Board, a hardship unique to the particular property. <br />
