1 <br /> The Board found that the proposed development of the land <br /> described is the best use of the land and more suitable than the <br /> allowed use already granted as a single lot subdivision, and that <br /> the use of the premises would not be detrimental to the Town or <br /> area by reason of excessive traffic noise or demand on community <br /> facilities. The Board also established that granting the permit <br /> would be in the best interest of the community, and would be in <br /> harmony with the general purpose and intent of the ordanance or <br /> By-law, and that the Petitioner met or exceeded the requirements <br /> for a multi-family unit development as provided for in the zoning <br /> By"=laws. Town of Mashpee, and the Planning Board. <br /> Upon motion duly made and seconded the Board voted unanimously <br /> to grant the request for a Special Permit to Gilmore G. Gessner and <br /> to incorporate the following conditions; <br /> 1. This Special Permit authorizes the construction of <br /> a 30-unit condominium complex together with the <br /> ammenities described; and does not allow a multi-family <br /> rental development use. <br /> 2. The developer must maintain the roads, sidewalks, <br /> utilities, and provide snow removal, until the <br /> condominium unit owners association takes over control <br /> of the property, or until the units are eighty percent <br /> (80%) sold, whichever comes last, at which time the <br /> unit owners association is to maintain roads, sidewalks, <br /> utilities, and provide snow removal. <br /> 3. All signs shall be constructed of wood, and if illuminated, <br /> illuminated from the exterior. The sign should be in <br /> harmony with the aesthetics of the area. <br /> 4. Signs advertising the property shall also meet the above <br /> requirements and shall be no larger than twenty-five (25) <br /> square feet. <br /> 5. A member of the Board of Appeals, together with the <br /> building inspector, and Gilmore G. Gessner, who will be <br /> the representative for this project, will inspect the <br /> project,in the following stages; <br /> a. when foundations are completed <br /> b. at the conclusion of framing <br /> c. final completion <br /> - 2 - <br />
