TOWN OF MASHPEE
BOARD OF APPEALS
TOWN HALL, MASHPEE, MASSACHUSETTS 02649
py$ gyp. DECISION
RE: ' Petition of John C. Hall for a Variance Case #V-84-12-056
A Petition was filed by John C. Hall of Mashpee, Massachusetts
for a Variance for permission to vary the 15 foot sideline require-
ment on property located on 2 Seaview Ave. , Popponessett, Mashpee,
Massachusetts.
Notice was duly given to abutters in accordance with Mass-
achusetts General Laws Chapter 40A. Notice was given by publica-
tion in the Falmouth Enterprise, a newspaper of general
circulation in the Town of Mashpee on December 5, 1984 and Decem-
ber 12, 1984 a copy of which is attached hereto and made a part
hereof.
A public hearing was held on the petition at the Mashpee
Town Mall on Wednesday, January 23, 1985, at 7 : 30 p.m. at which
time the following members of the Board of Appeals were present
and acting throughout: Manuel Costa, William Hanrahan, and Thomas
Sexton.
The Board reviewed the plans and a letter dated January 9,
1985 from M. David Kelleher, M.D. , concerning Mr. Hall ' s arthritis.
The letter had been accepted on January 16, 1985, but due to the
absence of Manuel Costa at that time the Board could not vote,
because he had been one of the original members who sat for this
hearing. The Building Inspector, Douglas Boyd also noted a grade
problem at this time.
After some discussion the Board found, the hardship to be
both medical and the topography of the lot.
