: -2- <br /> I. No more than 750 dwelling units may be built on the site. <br /> 2. The construction of the P.R.C. shall be phased over a period of eight <br /> (8) years. Before submission of the detailed plans of each phase to the <br /> Mashpee Planning Board, as required by Section 9.5, said plans shall be <br /> submitted for review and approval to the Board of Appeals as specified <br /> hereafter to determine their consistency with the terms and conditions <br /> of this Special Permit Modification. (See Condition #30.) <br /> 3. No more than 100 dwelling units may be granted certificates of occupancy <br /> in any one year. <br /> 4. At least five (5) percent of all units and all common facilities shall be <br /> so constructed as to be accessible to the handicapped in accordance <br /> with Massachusetts Law. <br /> 5. Uses permitted pursuant to Section 9.536 shall be specifically limited <br /> to those set forth in Section 6.30 and shall be located as indicated <br /> on the Master Site Development Plan. Further, such facilities shall be <br /> for the exclusive use of the residents of the P.R.C. and not for the use <br /> of the general public, and shall not have a separate entrance from roads <br /> bordering the site. <br /> 6. For the proposed beach and recreational areas on John's Pond, if permitted <br /> by the Mashpee Conservation Commission, the following regulations <br /> shall apply: <br /> a. use shall be limited to residents of the P.R.C., their families and <br /> their guests; <br /> b. no parking will be permitted in the proposed beach and dock areas; <br /> C. only one power boat will be permitted to be owned by the Condominium <br /> Association. <br /> 7. The clubhouses, swimming pools, tennis courts, sewer and water systems <br /> and all other service amenities shall be completed and work must be <br /> commenced on the golf course prior to the issuance of the first occupancy <br /> certificate for any dwelling unit and said course must be completed before <br /> the 101st occupancy certificate is issued. <br /> 8. Upon the issuance of the 200th occupancy certificate, the Condominium <br /> Trust shall operate a shuttle bus system for the use of residents with <br /> route to local shopping areas, the proposed beach and docks and the Mashpee <br /> Senior Citizens Center. <br /> 9. Time sharing or interval ownership, regardless of the method or form <br /> of same, is specifically prohibited. <br /> 10. Adjacent to Martha's Pond there shall be a 100 foot buffer zone wherein <br /> no structure or roads shall be situated. Any other construction or removal <br /> of vegetation in said zone or any dredging works shall require Conservation <br /> Commission approval as required by Massachusetts Law. <br />
