TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> . . TOWN HALL, MASHPEE, MASSACHUSETTS 02649 <br /> r•98 DECISION <br /> RE: P.F. O' Connor, Inc. for a Special Permit Case #SP-86-02-012 <br /> A Petition was filed by P.F. O' Connor, Inc. of Mashpee, <br /> Massachusetts for a Special Permit under Section 6. 3E8 & G6 <br /> of the Land Use Requirements. for permission to operate a lum- <br /> ber yard/storage in a C-2 and I1 Zoning District on property <br /> located on Route 1305 Assessor' s Map 19, Parcel 10, Mashpee, <br /> Massachusetts. <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was give by <br /> publication in the Falmouth Enterprise a newspaper of general <br /> circulation in the Town of Mashpee on January 29, 1986 and <br /> February 5, 1986, a copy of which, is attached hereto and <br /> made a part hereof. <br /> A public hearing was held on the petition at the Mashpee <br /> Town Hall on Wednesday, February 12, 1986 at 7 :30 p.m. at <br /> which time the following members of the Board of Appeals were <br /> present and acting throughout : William Hanrahan, Cheryl Haw- <br /> ver and Peter Lawrence. <br /> The Board finds P.F. O' Connor' s application non-detri- <br /> mental to the intent of the zoning By-Laws. <br /> The Board states that the Special Permit does not set <br /> a precedent for an intensive use going into a less intensive <br /> use and states more generally that this is not a precedent <br /> for a general extension of the over-lapping of the zone. <br /> Upon motion duly made and seconded the Board of Appeals <br /> voted unanimously to grant the Special Permit as requested <br /> subject to the following conditions : <br /> 1. No retail business permitted . in the I1 Industrial <br /> District and no Industrial Business permitted in <br /> the C-2 Business District. <br /> 2. The Special Permit meets all requirements requested <br /> by Design Review Committee. <br /> 3. A Landscaping Bond posted in the sum of $16, 000. 00 <br />
