TOWN OF MASHPEE
BOARD OF APPEALS
TOWN HALL, MASHPEE, MASSACHUSETTS 02649
DECISION
RE : Petition of Paul 0 . Ginouves for a Variance Case #V-85-11-063
A petition was filed by Paul 0 . Ginouves of Waldron Ave . , Summit ,
N . J . for a Variance for permission to vary the sideline requirement in
an R-3-M zoning district on property located on Uncle Edwards Road ,
Popponesset , Mashpee , Massachusetts .
Notice was duly given to abutters in accordance with Massachusetts
General Laws Chapter 40A . Notice was given by publication in the .
Falmouth Enterprise , a newspaper of general circulation in the Town
of Mashpee on October 30 , 1985 and November 6 , 1985 a copy of which is
attached hereto and made a part hereof .
A public hearing was held on the petition at the Mashpee Town Hall
on Wednesday , November 13 , 1985 , at 7 : 30 p . m. at which time the following
members of the Board of Appeals were present and acting throughout :
William Hanrahan , Michael Makunas and Manuel Costa .
Attorney Thomas Boyd represented Mr . Ginouves at this time . Mr .
Boyd was asked to return with more information concerning the existing'.
deck . The Board took the matter under advisement to allow him time to
gather information requested .
On January 8 , 1986 , Mr . James Sheridan came before the Board to
add further arguements and provided the Board with a number of photographs
of the property and deck . After looking over the photographs it was the
feeling of the Board that it would not be in the best interest to remove
the deck and leaving the existing deck would not be detrimental to the
Town'.
