TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> TOWN HALL, MASHPEE, MASSACHUSETTS 02649 <br /> DECISION <br /> r.� <br /> RE : Petition of Bayshore , Inc . for a Special Permit Case #SP-85-12-072 <br /> A petition was filed by Bayshore , Inc . of Mashpee , Massachusetts <br /> for a Special Permit for permission to cluster subdivide in. an R-2 <br /> zoning district on property located off of Falmouth-Sandwich Road , <br /> Assessors Map 40 , Parcel 2 , Mashpee , Massachusetts . <br /> Notice was duly given to abutters in accordance with 'Massachusetts <br /> General Laws Chapter 40A . Notice was given by publication in the <br /> Falmouth Enterprise , a newspaper of general circulation in the Town <br /> of Mashpee on November 27 , 1985 and December 4 , 1985 a copy of which <br /> is attached hereto and made a part hereof . <br /> A public hearing was held on the petition ' at the Mashpee Town Hall <br /> on Wednesday, December 11 , 1985 , at 7 : 30 p . m. at which time the following <br /> members of the Board of Appeals were present and acting throughout : <br /> Manuel Costa , Michael Makunas and Cheryl Hawver . <br /> Mr . Michael Dunning represented Bayshore , Inc . in this matter . <br /> In addition Arlene M . Wilson from BSC/Cape Cod Survey Consultants reported <br /> on the surface water quality impacts from this development as well as <br /> their suggested mitigation measures . Ms . Wilson also reported on the <br /> groundwater quality testing . Mr . Rue addressed the burial ground found <br /> on a portion of this parcel. He explained that they had been in touch <br /> with the archeological survey team from U Mass . Once boundaries are <br /> put on the site , the burial ground will be set aside as open space . <br /> Charles. Alexander told the Board that he would like to see some <br /> sort of buffer between his property and this development , an untouched <br /> area left natural . <br /> It was the Board ' s feeling that the presentation for this application <br /> was complete and addressed all of the important issues . In addition it <br /> was felt that this was the best possible use for this land . <br />
