Pender RECEIVED <br /> 66 Willow Street <br /> Clinton, Mass. 01510 1S <br /> May 12, 1986 MAN P61 TOWN CLERIC <br /> Board of Appeals <br /> Town of Mashpee <br /> re: Lot 11A & lot 13A <br /> Wilann Road, Mashpee <br /> Dear Board of Appeals <br /> On October 10, 1985 we signed a Purchase and Sale <br /> Agreement with Hamurco Realty Corporation to buy lots 11A <br /> and 13A situated on Wilann Road in the Town of Mashpee. <br /> Both lots are corner lots. These parcels were represented ` <br /> to us by one Paul Cotton of Premier Realty as being "Definite, <br /> buildable lots. " Mr. Cotton told us the lots were part of an <br /> already approved subdivision, as evidenced by the houses already <br /> constructed on lots adjacent to ours. Mr. Cotton stated the <br /> only possible reason for the lots not being buildable were <br /> if they did not perk. <br /> William Pender asked, "Do the lots have the required <br /> frontage and square footage to satisfy Town requirements?" <br /> Mr. Cotton answered, "Yes. No problem. People are already <br /> building on lots smaller than yours. " <br /> On November 1, 1985 we executed the Purchase and Sale <br /> Agreements and gave $49, 000 for lots 11A and 13A to Hamurco <br /> Realty Corporation . At this time we also gave $2,400 for <br /> a deposit on lot 17 on WilarA Road. We subsequently <br /> contracted Allinson Engineering of Warwick'; Rhode Island to <br /> design sewerage disposal plans for the three lots. Allinson <br /> Engineering did so and we paid them $3, 375. On November 5, <br /> 1985 we received approval from the Board of Health to install <br /> wells. We also had lot 11A and 13A cleared at a cost of <br /> $700. 00. We have contracted Aqua-Jet of Mashpee to dig the <br /> wells and install the septic systems. Now we have been denied <br /> building permits. <br /> Due to our inability to obtain building permits for the <br /> lots, we humbly ask you for a variance to build on these lots. <br /> A negative determination would cause us an extreme hardship. <br /> We feel due to the fact our lots are quite a bit larger than <br /> the other lots in the subdivision which have already been built <br /> on, that desirable relief may be granted without substantial <br /> detriment to the public good and without nullifying or <br /> -1- <br />
