The Petitioner appeared on August 17, 1988 and presented a <br /> plan entitled, "Southport of Cape Cod Perimeter Setback Plan, " by <br /> E.J. Flynn Engineers , Inc. , a copy of which is filed with the <br /> 1 records of this case. Said plan shows the proposed location of <br /> the buffer zone for the entire project. As to Phase I , it <br /> incorporates the buffer zone approved by this Board on September <br /> r <br /> 11, 1986 . <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given by <br /> c <br /> publication in the Falmouth Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee on August 3 , 1988 and <br /> August 10 1988 , a copy of which is attached hereto and <br /> made a part hereof. <br /> A public hearing was held on the petition at the Mashpee <br /> Town Hall on Wednesday, August 17 , 1988 at 7 : 30 p.m. , at which <br /> time the following members of the Board of Appeals were present <br /> and acting throughout: William Hanrahan, Michael Makunas, and <br /> Edward Govoni . <br /> After the hearing, and based on evidence presented by the <br /> Applicant, the Board found that the proposed modification of the <br /> buffer zone is in harmony with the general purpose and intent of <br /> the Mashpee Zoning By-Law and complies with the general and <br /> specific provisions thereof. <br /> Upon motion duly made and seconded, the Board of Appeals <br /> voted unanimously on August 17, 1988 to grant the modification of <br />
