i <br /> DECISION OF NOTICE OF APPEAL <br /> Re: Request for Variance by Multi-Vest Properties , Inc. <br /> Case No. V-88-07-060 <br /> A request for a variance under Section 7 . 4 of the Land Use <br /> Requirements for permission to vary the frontline setback in an <br /> R-3 zoning district on property located at Lot 5 Victoria Circle <br /> (Map 29 , Lot 29 ) , Mashpee, Massachusetts , was filed by Multi-Vest <br /> Properties , Inc. of Mashpee, Massachusetts . <br /> Notice of applicant' s request was duly given to abutters in <br /> accordance with Massachusetts General Laws Chapter 40A. Notice <br /> was given by publication in the Falmouth Enterprise, a newspaper <br /> of general circulation in the Town of Mashpee on August 3 and <br /> August 10 , 1988, a copy of which is attached hereto and made a <br /> part hereof . <br /> A public hearing was held on the request at the Mashpee Town <br /> Hall on Wednesday, August 17 , 1988 at 7 : 30 p.m. , at which time <br /> the following members of the Board of Appeals were present and <br /> acting throughout: William Hanrahan, Michael Makunas, and Edward <br /> Govoni . <br /> Counsel, representing the applicant, informed the Board that <br /> the lot in question is part of a cluster subdivision permit <br /> issued by the Planning Board sitting as the Board of Appeals in <br /> February of 1986 .
