BOX 1108 <br /> '�nececo^ MASHPEE, MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A VARIANCE <br /> Re: Petition of Edward & Aline Amesbury for a Variance - Case: V-88-08-064 <br /> A Petition was filed by Edward and Aline Amesbury of Mashpee, <br /> Massachusetts for a variance under Section 7.4 of the Land Space <br /> Requirements for permission to vary the side yard setback in an R-3 <br /> zoning district on property located at 58 Running Light Way (Map 111, <br /> Lot 66) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the <br /> Falmouth Enterprise, a newspaper of general circulation in the Town <br /> of Mashpee on August 31 and September 7, 1988, a copy of which is <br /> attached hereto and made a part thereof. <br /> A public hearing was held on the petition at the Mashpee Town <br /> Hall on Wednesday, September 14, 1988 at 7:30 P.M. at which time <br /> the following members of the Board of Appeals were present and <br /> acting throughout: William Hanrahan, Michael Makunas and Richard <br /> Halpern. <br /> The Board was informed that the applicants propose to build a <br /> garage/addition on a non-conforming lot. The lot in question was <br /> understood to have been originally under the New Seabury zero lot line <br /> cluster rules but was recently found to be outside of the New Seabury <br /> special permit zone. The Board determined that significant hardship <br /> was involved and that structures on the same street have been allowed <br /> to construct mistakenly under the New Seabury Zero Lot Line Cluster rules. <br /> Upon motion duly made and seconded, the Board of Appeals voted <br /> unanimously on October 12, 1988 to allow a sideline variance of-,5 feet <br /> and reduce the sideline setback requirement from 15 feet to 10 feet. <br />
