BOX 1108
'nececo^ MASHPEE, MA 02649
BOARD OF APPEALS
DECISION
FOR A VARIANCE
Re: Petition of Edward & Aline Amesbury for a Variance - Case: V-88-08-064
A Petition was filed by Edward and Aline Amesbury of Mashpee,
Massachusetts for a variance under Section 7.4 of the Land Space
Requirements for permission to vary the side yard setback in an R-3
zoning district on property located at 58 Running Light Way (Map 111,
Lot 66) Mashpee, Massachusetts.
Notice was duly given to abutters in accordance with Massachusetts
General Laws Chapter 40A. Notice was given by publication in the
Falmouth Enterprise, a newspaper of general circulation in the Town
of Mashpee on August 31 and September 7, 1988, a copy of which is
attached hereto and made a part thereof.
A public hearing was held on the petition at the Mashpee Town
Hall on Wednesday, September 14, 1988 at 7:30 P.M. at which time
the following members of the Board of Appeals were present and
acting throughout: William Hanrahan, Michael Makunas and Richard
Halpern.
The Board was informed that the applicants propose to build a
garage/addition on a non-conforming lot. The lot in question was
understood to have been originally under the New Seabury zero lot line
cluster rules but was recently found to be outside of the New Seabury
special permit zone. The Board determined that significant hardship
was involved and that structures on the same street have been allowed
to construct mistakenly under the New Seabury Zero Lot Line Cluster rules.
Upon motion duly made and seconded, the Board of Appeals voted
unanimously on October 12, 1988 to allow a sideline variance of-,5 feet
and reduce the sideline setback requirement from 15 feet to 10 feet.
