MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A VARIANCE <br /> U Re: Petition of Gerald Gaffin for a Variance - Case V-88-08-065 <br /> A Petition was filed by Gerald Gaffin of Framingham, Massachusetts <br /> for a Veriance for permission to vary the side and rear yard setback in an <br /> R-3 zoning district on property located at 89 Mizzenmast Road (Map 125 - Lot 229) <br /> Mashpee, Massachusetts. <br /> Notice was- duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, on <br /> August 31 and September 7, a copy of which is attached hereto and made a <br /> part hereof. - <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, September 14, 1988 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> William Hanrahan, Michael Makunas and Richard Halpern. <br /> The Board was informed .that the applicant proposes to contruct a <br /> tool shed at the rear of his property requiring a variance. The Board <br /> determined that the topography of the lot created a hardship. <br /> Upon motion duly made and seconded, the Board of Appeals voted <br /> unanimously to grant a rear setback variance of 6'4" and a side setback <br /> of 9' . <br /> The Board found this variance request will not derogate from the <br /> intent of the By-Laws and would not be a detriment to the surrounding <br /> neighborhood. <br />
