MA 02649
DECISION
RE: Petition of Marilyn and Barnett Berliner for a Variance Case #V-88-01-05
(owner on record; Marilyn and Barnett Berliner)
A Petition was filed by Marilyn and Barnett Berliner of Mashpee,
Massachusetts for a Variance for permission to vary the lot size requirements
in a R-5 Zoning District on property located on Sturgis Landing, (map 20,
parcels 39 & 40) , Mashpee, Massachusetts.
Notice was duly given to abutters in accordance with Massachusetts
General Laws Chapter 40A. Notice was given by publication in the Falmouth
Enterprise, a newspaper of general circulation in the Town of Mashpee on
December 30, 1987 and January 6, 1988, a copy of which is attached hereto
and made a part hereof.
A public hearing was held on the -tition at the Mashpee Town Hall
on Wednesday, January 13, 1988 at 7:30 p.m. at which time the following
members of the Board of Appeals were present and acting throughout: William
Hanrahan, Michael Makunas and Edward Govoni .
The Board was informed that the subdivision met approval from the
Planning Board in 1985. Counsel , repr=senting the Applicant, informed the
Board that the petitioner proposes to =move the dwelling on lot 8, convert
the dwelling on lot 9 into a boathouse _nd construct a new dwelling, which
would straddle the lot line between the two lots, thereby removing the
possibility of the lots reverting to tn_ buildable lots. The Board ascer-
tained that adequate frontage will be -_intained on the private way as
shown on plan, as required in the prov ' _'_ons of the Massachusetts General
Laws Chapter 41 , subsection 81 (0) .
