BOARD OFCAPPEAL <br /> P. O. BOX 1108 <br /> �ABLE� MASHPEE. MA 02649 <br /> DECISION <br /> RE: Petition of Richard S. Dubin for a Variance Case #V-88-02-016 <br /> A Petition was filed by Richard S. Dubin of Mashpee, Massachusetts <br /> for a Variance for permission to vary the front setback requirement and <br /> for permission to construct a dwelling within 50 feet of the wetlands in <br /> a R-3 Zoning District on property located on lot 56 Waterline Drive, (map <br /> 120, parcel 142) , Little Neck Bay, Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee on <br /> March 9 & 16, 1988, a copy of which is attached hereto and made a part <br /> hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, March 24, 1988 and was continued until April 13, 1988 at <br /> 7:30 p.m. at which time the following members of the Board of Appeals were <br /> present and acting throughout: Michael Makunas, Cheryl Hawver and Richard <br /> Halpern. <br /> Recommendations were received from the Conservation Commission. <br /> Amendments to plans presented were accepted by the Board. <br /> Upon motion duly made and seconded the Board of Appeals voted unani- <br /> mously on April 13, 1988 to grant the front setback Variance of 18 feet <br /> from the right of way and the 31 foot Variance within the wetland area <br />
