All displays, sales and flea market operations shall be located at <br /> the rear of the current site of the Mini-Golf and Ice Cream shop <br /> operations. <br /> 12. The Applicant shall erect a stockade fence shielding the dumpster <br /> or other trash disposal receptacle and the farm tractor or any other <br /> trash disposal receptacle and the farm tractor or any other equipment <br /> used in connection with the maintenance and conduct of the business, <br /> so that the same may not be seen from any road or from any abutting <br /> property. <br /> 13. The Applicant shall maintain the site to remove paper, garbage and <br /> other debris from the grounds and shall trim all excessive vegeta- <br /> tion, meaning grass shall be mowed and landscaping maintained in a <br /> neat and orderly manner, and parking areas and routes of vehicle <br /> travel shall be maintained in a neat and hard packed appearance. The <br /> site shall be graded so as to maintain a level area pitched to drain <br /> away from abutting roads and property and to minimize the pooling of <br /> water. The grade of the site shall be maintained as presently exists <br /> and all drainage originating from the site shall be self-contained on <br /> the site. <br /> 14. This grant of Special Permit is not transferable by the Applicant <br /> except to members of his immediate family, meaning spouse and chil- <br /> dren, and will expire January 1 , 1989. The Applicant may apply <br /> annually thereafter for renewal of this Special Permit and receive <br /> a new grant thereof following public hearing and review of the opera- <br /> tion and its impact upon the neighborhood and the general welfare of <br /> the inhabitants of the Town and subject to the addition, deletion or <br /> modification of the limitations imposed herein. <br /> 15. The grant of this Special Permit is expressly conditioned upon com- <br /> pliance with the limitations and conditions imposed herein and in the <br /> event of any alleged violation thereof and subsequent findings by the <br /> Board of Appeals, after notice and hearing, that a substantial viola- <br /> tion has willfully occurred, this Special Permit may be rescinded by <br /> unanimous vote of the Board of Appeals. <br /> 16. No food shall be allowed to be served, nor sold within the limits of <br /> the boundaries unless a lessee shall be licensed by the Mashpee Board <br /> of Health to serve food at the restaurant or the outside booth (hot <br /> dog stand) for consumption on premises. No cookies, cakes, vegetables <br /> (excepting home grown by vendor) no surplus foods (i .e. damaged' cans) <br /> can be sold for any reason. No home baked/prepared foods to be sold. <br /> 17. At their discretion, the Mashpee Board of Health may waive any or all <br /> provisions listed in condition #16 of this Special Permit. <br /> 18. The signs on Great Neck Road are to be removed prior to the 1988 open- <br /> ing, unless sign permits are obtained. <br />
