Dubin TR for a Variance Case: V-89-12-05 <br /> A Petition was filed by Barbara H. Dubin TR of Hyannis, Massachusetts <br /> for a Variance under Section 7.4 of the Land Space Requirements for <br /> permission to vary the requirements in an R-3 zoning district on <br /> property located at Lot 1, Route 28 (Map 87, Lot 6) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on December 28, 1988 and January 4, 1989, a copy of which is attached <br /> hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall on <br /> Wednesday, January 11, 1989 at 7:30 p.m. at which time the following members <br /> of the Board of Appeals were present and acting throughout: William Hanrahan, <br /> Cheryl Hawver and Michael Makunas. <br /> Attorney Richard Dubin informed the Board that the Applicant proposes <br /> to construct an office building on a lot bordered by Route 28 and Whiting's <br /> Road. The lot is now in an R-3 zoning district but was in an I-1 district <br /> and is protected for office building use until February 6, 1989. <br /> Mr. Dubin reviewed plans of the lot and stated need for a variance in <br /> setback requirement from Whiting's Road. <br />
