Spohr for a Variance <br /> Case: V-89-01-10 <br /> A Petition was filed by Charles D. Spohr of Mashpee, Massachusetts <br /> for a Variance under Section 7.6 of the Land Space Requirements for <br /> permission to construct a single-family residence in an R-3 zoning <br /> district on property located at 29 Hamblin Road (Map 120, Lot 32) <br /> Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on January 11 and January 18, 1989, a copy of which is attached hereto <br /> and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, January 25, 1989 at which time the following members of <br /> the Board of Appeals were present and acting throughout: William Hanrahan, <br /> Cheryl Hawver and Richard Halpern. <br /> Mr. Spohr informed the Board that the Variance was required since <br /> Hamblin Road was not a paved access roadway. Abutters present stated <br /> that the road is adequate for fire department vehicles. <br /> Recommendations were received from the Mashpee Fire Department <br /> who confirmed that fire fighting apparatus could reach the lot. <br /> The Board determined that the topography of the lot created a <br /> hardship. The Board also established that granting this Variance <br /> would not be a detriment to the Town and would be in harmony with <br /> the general purpose and intent of the ordinace or By-laws. <br />
