` R lIIfUlt of c ag4pPE
P. O. BOX 1108
MASHPEE. MA 02649
BOARD OF APPEALS
DECISION
FOR A SPECIAL PERMIT
RE: Charles .D. Sphor for a Special Permit Case: SP-89-01-09
A Petition was filed by Charles D. Sphor of Falmouth, Massachusetts
for a Special Permit for permission to construct a board walk in an
R-3 zoning district on property located at 29 Hamblin Road (Map 120,
Lot 32) Mashpee, MA. (Owners of record: Henry N. and Elizabeth B.
Spohr) .
Notice was duly given to abutters in accordance with Massachusetts
General Laws Chapter 40A. Notice was given by publication in the
Falmouth Enterprise, a newspaper of general circulation in the Town
of Mashpee on January 11 and January 18, 1989, a copy of which is
attached hereto and made a part hereof.
A public hearing was held on the Petition at the Mashpee Town
Hall on Wednesday, January 25, 1989 and continued on March 22, 1989
at 7:30 p.m. The following members of the Board of Appeals were
present and acting throughout: William J. Hanrahan, Cheryl A. Hawver
and Richard E. Halpern.
Mr. Sphor represented the Petition and explained that he planned
to build an elevated walkway ,4' in width, 40' long and 3' above the
existing growth. The hearing was continued since neither the
Conservation Commission nor the Shellfish Constable had received plans.
At a Special Meeting on March 22, 1989 the Board was informed
that the Shellfish Commission had no objection to the boardwalk.
The Conservation Commission submitted a letter stating they had no
objection to the plans as long as no docking facilities were planned
at the end of the boardwalk. Abutters present questioned the location
of a proposed home on the lot but had no comments on the boardwalk.
