MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A VARIANCE <br /> RE: Petition of Hamurco Associates for a Variance V-89-06-67 <br /> 21 Wilann Road (Map 46, Block 42) (Formerly Lot 46 Wilann Road) <br /> A .Petition was filed by Hamurco Associates of Holliston, <br /> Massachusetts for a Variance for permission to vary the lot size and <br /> frontage requirements in an R-5 zoning district on property located <br /> at 21 Wilann Road (Map 46, Block 42) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with the <br /> Massachusetts General Laws Chapter 4OA. Notice was given by <br /> publication in The Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee on July 24 and July 31, 1989, a copy of which is <br /> attached hereto and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, August 9, 1989 at 7:30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Cheryl A. Hawver, Richard E. Halpern and John J. Friel. <br /> Attorney Richard Anderson represented the applicant. He explained <br /> that a variance had been granted on this lot on December 10, 1986 and <br /> a six-month extension of the variance had been granted on February 11, <br /> 1988. The variance has now expired and Town Counsel had determined <br /> that a new hearing was necessary. The Board was informed that the lot <br /> is one of six Hamurco lots in the subdivision on which construction <br /> had not commenced. Due to the limitations as to the number of building <br /> permits that could be issued, the rights authorized by the earlier <br /> variance could not be exercised. <br />
