ZONING BOARD OF APPEALS MEETING <br />• Wednesday, July 13, 1988 <br />Present: William Hanrahan, Chairman, Richard Halpern, Edward Govoni and <br />Michael Makunas <br />Hearing: Ted Houghton (Continued from June 8, 1988) William Hanrahan, <br />Richard Halpern and Edward Govoni sitting. <br />Mr. Hanrahan opened the meeting with a continuance of a June 8 hearing <br />request of Mr. Ted Houghton of a variance under Section 7.4 of the Land <br />Space Requirements in an R-3 zoning district on property located at <br />7 Simons Narrows Road, Map 76, Parcel 89, for permission to vary the <br />sideline setback requirements. <br />Mr. Houghton stated that he did not believe it was an engineering error; <br />thought the back line stake was moved somehow, by kids or whatever. <br />Richard Halpern asked Mr. Houghton if it was the back line or the side <br />line that was moved. <br />Mr. Houghton stated it was the sideline. The front line is fixed by a <br />telephone pole. The back side line is staked and he was working with <br />stakes and thought it was on line. <br />Mr. Hanrahan - There is a concrete bound on Simons Narrows side for line <br />between two lots. <br />Mr. Houghton - I usually don't go through and resurvey the whole lot. <br />• Mr. Sam Sutter, representing Mr. Houghton and'Mr. Bornstein, gave a <br />brief history of Mr. Bornstein's lot/house, stating that Mr. Houghton <br />built the house for Mr. Bornstein, who owns the land. They received the <br />Certificate of Occupancy on 6111187. Mr. Bornstein was going to <br />refinance the house and in the bank's process of researching, the <br />violation of sideline setbacks was discovered, in that the garage was <br />only 9 1/2 feet from Mr. Parachi's sideline instead of the required <br />15 feet. <br />Mr. Hanrahan asked Mr. Sutter of what nature the hardship would be if <br />the variance was not granted. <br />Mr. Sutter stated that either the garage would have to be torn out, or <br />it would make it very difficult for Mr. Bornstein and his family to sell <br />his house. He stated he did not believe it would be a hardship on <br />Mr. Parachi, as his land was not even cleared. <br />Mr. Hanrahan - Would you say that the hardship is primarily economical? <br />• Mr. Sutter - Yes. <br />
