• It is the opinion of the Board of Appeals that this lot'is
protected from the provision of Section 7.7 of the Zoning By -Law by
virtue of Chapter 40A, Section 6, Paragraph 4 of the Massachusetts
General Laws. This statutory protection is not applicable to any change
in the uses allowed on the property and is applicable only to changes in
area, frontage, width, yard or depth requirements. The provisions of
7.7 of the Zoning By -Law, dealing with setbacks, are applicable to this
statutory protection.
In summary the Board of Appeals has determined that a variance is
not required.
Sincerely,
William J. Hanrahan, Chairman
Michael Makunas
Richard Halpern
Reviews
Richard Halpern - Joe Murphy has said that on August I the Building and
Health departments are moving to Deer Crossing. He does not know where
• the Board of Appeals will be. 1 think we should be near the Building
Inspector's. .The separation is due to a Union grievance that too much
time was being utilizied by Building Inspector's office staff answering
Board of Appeals questions and problems.
Fern Anderson letter - Sunset Strip. Due to phasing schedules in the
By -Laws, problems are arising as to number of permits issued per month
and to whom. One developer can conceivably grab up all the available
permits for that month. It is also possible for someone to walk in to
the Building Inspector's office and take out permits on someone else's
property.
Mr. Makunas - Sunset Strip got caught in a situation where if an
individual owned 3 lots or less he could subdivide those 3 lots and
build on them. Because he owned more than 3 he got cought. They
elected to come to the Board of Appeals for a variance rather then go
before Town Meeting. The Board granted the variance on the lots.
Paul Cotton didn't get a commision on those 3 lots, so he dropped them
from the list. That's how they were caught. If you don't use your
variance you lose it. Now they are asking for these lots to be rolled
40 over. I believe it has to be by Public Hearing and the fee is $50.00
per lot. I think they have two years to act under the variance.
