• It is the opinion of the Board of Appeals that this lot'is <br />protected from the provision of Section 7.7 of the Zoning By -Law by <br />virtue of Chapter 40A, Section 6, Paragraph 4 of the Massachusetts <br />General Laws. This statutory protection is not applicable to any change <br />in the uses allowed on the property and is applicable only to changes in <br />area, frontage, width, yard or depth requirements. The provisions of <br />7.7 of the Zoning By -Law, dealing with setbacks, are applicable to this <br />statutory protection. <br />In summary the Board of Appeals has determined that a variance is <br />not required. <br />Sincerely, <br />William J. He does not know where <br />• the Board of Appeals will be. 1 think we should be near the Building <br />Inspector's. .The separation is due to a Union grievance that too much <br />time was being utilizied by Building Inspector's office staff answering <br />Board of Appeals questions and problems. <br />Fern Anderson letter - Sunset Strip. Due to phasing schedules in the <br />By -Laws, problems are arising as to number of permits issued per month <br />and to whom. One developer can conceivably grab up all the available <br />permits for that month. It is also possible for someone to walk in to <br />the Building Inspector's office and take out permits on someone else's <br />property. <br />Mr. Makunas - Sunset Strip got caught in a situation where if an <br />individual owned 3 lots or less he could subdivide those 3 lots and <br />build on them. Because he owned more than 3 he got cought. They <br />elected to come to the Board of Appeals for a variance rather then go <br />before Town Meeting. The Board granted the variance on the lots. <br />Paul Cotton didn't get a commision on those 3 lots, so he dropped them <br />from the list. That's how they were caught. If you don't use your <br />variance you lose it. Now they are asking for these lots to be rolled <br />40 over. I believe it has to be by Public Hearing and the fee is $50.00 <br />per lot. I think they have two years to act under the variance. <br />
