BOARD OF APPEALS <br />• MINUTES <br />September 14, 1988 <br />At 7:30 P.M. on Wednesday, September 14, 1988 the Board of Appeals held <br />a meeting at the Mashpee Town Hall. Board members present and acting through- <br />out were: William Hanrahan, Michael Makunas, Cheryl Hawver, Edward Govoni <br />and Richard Halpern. Douglas Boyd, Building Inspector, was in attendance. <br />Jack Sullivan (continued from August 10, 1988) - Requests a Variance <br />under Section 7.4 (3) of the Land Use Requirements for permission to vary <br />the front setback in an R-3 zoning district on property located at 54 Forestdale <br />Road, (Route 130) (Map 27, Lot 73) Mashpee, MA. <br />Members sitting: C. Hawver, E. Govoni and R. Halpern <br />George Thorng of Arrow Engineering was present representing this petition. <br />He explained that the Applicant had commenced construction of a foundation <br />when it was discovered that the lot was bordered by a paper road which was <br />not on the assessors' maps thus creating a hardship. No abutters were present. <br />Mr. Govoni moved to grant the 15.9' setback from the paper road and a <br />39.5' setback from Forestdale Road per stamped consigned plan. Ms. Hawver <br />seconded and all agreed. <br />Pak Lam Tam (continued from August 10, 1988) - Requests a Special Permit <br />• under Section 6.1.9 of the Land Space Requirements for construction of a stairwell <br />and fixed pier on Mashpee Pond at property located at Lot 4 Sturgis Lane (Map 20, <br />Lot 46) Mashpee, MA. <br />Members sitting: C. Hawver, E. Govoni, R. Halpern <br />George Thorng of Arrow Engineering was in attendance representing this <br />petition. He presented revised plans for a stairway and seasonal dock rather <br />than the fixed pier which had been presented on August 10. The entire dock <br />and floats would be removed and stored upland in the winter. Lisa Hanscom, <br />Conservation Officer, stated that she had seen the plans and approved. There <br />were no comments from abutters. <br />Mr. Govoni motioned to grant the Special Permit as presented with the <br />docks removable. Ms. Hawver seconded. All agreed. <br />John Malloy (continued from August 17) - Requests a Special Permit under <br />Section 6, subsection 19 of the Land Use Requirements to construct and maintain <br />a walkway, pier, ramp, float and dock facility in an R-3 zoning district for <br />property located at Lot 166, Whippoorwill Circle (Map 125, Lot 151) Mashpee, <br />M- pursuant to an application dated Jan. 14, 1987. After a hearing held on <br />4/1/87, the Board of Appeals on 6/26/87 filed decision with the Mashpee Town <br />Clerk on such application, and an appeal to the Barnstable Superior Court <br />(Civil Action No. 87-593) was taken therefrom. Subsequently, such application <br />was remanded to the Board of Appeals by the Barnstable Superior Court for <br />the purpose of reopening the Public Hearing on this matter. <br />• Members sitting: W.
