MINUTES September 14, 1988 - 4 - BOARD OF APPEALS <br />• Amesbury (cont.) <br />Mr. Joseph Farley, an abutter, objected to the request for the 5' setback. <br />Mr. Tony Ferragamo, a resident of Mashpee, stated that he became aware <br />of the possibility that the lot might be out of the Special Permit and advised <br />Mr. Amesbury to seek a ruling from the Building Inspector. He commented that <br />he did not think the addition would be detrimental to the surrounding area <br />and had been approved by the New Seabury Architectural Review Committee. <br />Mr. Halpern recommended that the Board visit the property. Mr. Makunas <br />moved to take the Petition under advisement. Mr. Hanrahan seconded. All agreed. <br />Gerald Gaffin - Requests a Variance under Section 7.4 of the Land Use <br />Requirements for permission to vary the side and rear yard setback in an R-3 <br />zoning district on property located at 89 Mizzenmast Road (Map 125 -Lot 229) <br />Mashpee, MA. <br />Members sitting: W. Hanrahan, M. Makunas and R. Halpern <br />Mr. Gaffin's builder explained that the owner. wanted to construct <br />a tool shed but due to the topography of lot it was not possible to place it <br />within the setback requirements. Two letters were received from abutters in <br />favor of the petition. <br />• Michael Makunas moved to grant a rear setback variance of 6'4" and <br />a side setback of 9'. Mr. Halpern seconded. All agreed. <br />Bonwood Co. (Discussion) <br />Ron Bonvey of the Bonwood Co. explained that his Special Permit requires him <br />to improve Old Barnstable Road. In order to do this work he must have the approval <br />of the Director of Public Works and the Town Engineer, both of whom had questioned <br />the specific requirements. <br />The permit states that there will be 11' wide travel lanes, 4' paved shoulder and <br />slashed berms on each side. Mr. Makunas stated that the Board would issue a letter <br />specifying that there would be 11' travel lanes and 4' paved shoulder at the same <br />elevation with a white line to keep traffic off the shoulder. <br />Shellfish Department (Discussion) <br />Paul Somervell, Shellfish Constable, reported that the Town has sold 600 <br />shellfish permits. He feels that some of the building projects are endangering <br />the shellfish beds. Lisa Hanscom, Conservation Officer, stated that they will <br />have to start mapping the shellfish areas and present proposals for new by-laws <br />to protect the shellfish beds. <br />Mr. Halpern suggested that the Board of Appeals, the Conservation Officer and <br />the Shellfish Constable have discussion meetings to review the Wetlands Protection <br />Act. <br />Mary Tully <br />Elinor Walsh <br />
