1 BOARD OF APPEALS <br />• MINUTES <br />October 26, 1988 <br />At 7:30 p.m. on Wednesday, October 26, the Board of Appeals held a <br />meeting at the Mashpee Town Hall. Board members present and acting through- <br />out were: Michael Makunas, Edward Govoni and Richard Halpern. Mr. Douglas <br />Boyd was in attendance. <br />John Malloy (continued from September 14, 1988) <br />Mr. Halpern stated that he had received a request from the attorney <br />for John Malloy to continue the hearing until November 9 when he would have <br />the results of shellfish tests. Mr. Makunas moved to continue to November 9 <br />and Mr. Govoni seconded. All agreed. <br />Barry Stone - Requests a Variance under Section 7.7, 11C, 7.4 of the <br />Land Space Requirements for permission to add a garage and deck on property <br />located at 17 Compass Circle (Map 105, Lot 256) Mashpee, MA. <br />Members sitting: M. Makunas, E. Govoni, R. Halpern <br />Mr. Jim Pavlik and Mr. Jack Brown of New Seabury Engineering were in <br />attendance representing this application. Mr. Pavlik explained that the <br />application was presented for a Variance under Section 11C of the A.C.E.C. <br />but now learned that the area is not designated as such. They requested to <br />• amend the application to delete the 11C. He presented plans showing an <br />existing house with deck located 12' from wetlands. The owner proposes to <br />build an addition which will not be any cicEer to the wetlands than the present <br />location of the house. In addition they plan to build a deck and patio. <br />Mr. Pavlik stated he had an initial meeting with the Conservation <br />Commission and that the Commission had requested a reduction in the size of <br />the deck and this had been done. Mr. Govoni questioned the percentage of lot <br />coverage with the proposed plans. This had not been computed. <br />Mr. Makunas asked if a Purchase and Sale Agreement was involved since <br />a land exchange with an abutter was involved. Mr. Pavlik explained that there <br />was an equal exchange and that the Purchase and Sale was contingent on the <br />approval of a Variance. <br />Mr. Makunas explained that a Variance would be required under both Section <br />7.4 and 7.7 of the Zoning By-laws. Mr. Halpern asked if Mr. Pavlik could compute <br />the lot coverage. Mr. Makunas motioned to continue the hearing until later <br />in evening. Mr. Halpern seconded. All agreed. <br />Richard and Miriam Coffman - Request a Variance under Section 7.7 of <br />the Land Space Requirements for permission to construct an addition within <br />50 feet of the water on property located at 105 Whipporwill Circle (Map 125 <br />Lot 150) Mashpee, MA. <br />0 <br />Members sitting: M.
