MA 02649 BOARD OF APPEALS DECISION FOR A SPECIAL PERMIT RE: Petition of Harold Cohen for a Special Permit SP-90-01-01 A Petition was filed by Harold Cohen of Boston, Massachusetts for A Special Permit under Section 174-25.I.9 of the Zoning By-laws for permission to construct a timberwalkway in an R-3 zoning district on property located at 51 S. Waterline Drive (Map 120; Block 145) and Waterline South Drive (Map 120, Block 147: Owner of record: Christopher Burden, TR) . The proposed structure is designed to provide access to Great River Cove for property at 51 S. Waterline Drive (Map 120, Block 145) and 47 S. Waterline Drive (Map 120, Block 146) Mashpee, Massachusetts. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Enterprise, a newspaper of general circulation in the Town of Mashpee on December 22 and December 29, 1989, a copy of which is attached hereto and made a part hereof. A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, January 10, 1990 at 7:30 p.m. at which time the following members of the Board of Appeals were present and acting throughout: Cheryl A. Hawver, Michael A. Makunas and William J. Hanrahan. Paul Lolito represented the Applicant. He presented plans for a timber walkway designed to provide access to the water for two adjoining lots. The walkway would extend over 70 feet of saltmarsh. The walkway would be used for access to dinghys and no float is proposed. Comments were received from the Shellfish Constable stating that the project would not cause degradation to the coastal environment and suggesting that structure be used for dinghys only and have legal documentation that the structure serve both lots.
