MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: Petition of Harold Cohen for a Special Permit SP-90-01-01 <br /> A Petition was filed by Harold Cohen of Boston, Massachusetts for <br /> A Special Permit under Section 174-25.I.9 of the Zoning By-laws for <br /> permission to construct a timberwalkway in an R-3 zoning district on <br /> property located at 51 S. Waterline Drive (Map 120; Block 145) and <br /> Waterline South Drive (Map 120, Block 147: Owner of record: <br /> Christopher Burden, TR) . The proposed structure is designed to provide <br /> access to Great River Cove for property at 51 S. Waterline Drive <br /> (Map 120, Block 145) and 47 S. Waterline Drive (Map 120, Block 146) <br /> Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on December 22 and December 29, 1989, a copy of which is attached hereto <br /> and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall <br /> on Wednesday, January 10, 1990 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> Cheryl A. Hawver, Michael A. Makunas and William J. Hanrahan. <br /> Paul Lolito represented the Applicant. He presented plans for a <br /> timber walkway designed to provide access to the water for two <br /> adjoining lots. The walkway would extend over 70 feet of saltmarsh. <br /> The walkway would be used for access to dinghys and no float is <br /> proposed. <br /> Comments were received from the Shellfish Constable stating that <br /> the project would not cause degradation to the coastal environment and <br /> suggesting that structure be used for dinghys only and have legal <br /> documentation that the structure serve both lots. <br />
