Deery for a Special Permit SP-90-01-04 A Petition was filed by William J. and Gertrude M. Deery of Mashpee, Massachusetts for a Special Permit under Section 174.25.I.9 of the Zoning By-laws for permission to move and reconstruct an existing pier in an R-3 zoning district on property located at 122 Captain's Row (Map 96, Block 19) Mashpee, Massachusetts. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Enterprise, a newspaper of general circulation in the Town of Mashpee on December 22 and December 29, 1989, a copy of which is attached hereto and made a part hereof. A public hearing was held on the Petition at the Mashpee Town Hall on Wednesday, January 10, 1990 at 7:30 p.m. at which time the following members of the Board of Appeals were present and acting throughout: Cheryl A. Hawver, Michael A. Makunas and William J. Hanrahan. Gregory Taylor of Taylor Design represented the Applicant. He informed the Board that Mr. Deery had owned the dock for 20 years and learned that most of his dock was not on his property. He requested permission to remove the existing pier and float and relocate it. Comments were received from the Shellfish Constable stating that he had no objections to the new location. The Board determined that the use is in harmony with the general purpose and intent of the Zoning By-laws and complies with the provisions set forth within the By-laws. The Board requested a new set of plans eliminating proposed steps.
