Deery for a Special Permit SP-90-01-04 <br /> A Petition was filed by William J. and Gertrude M. Deery of <br /> Mashpee, Massachusetts for a Special Permit under Section 174.25.I.9 of <br /> the Zoning By-laws for permission to move and reconstruct an existing <br /> pier in an R-3 zoning district on property located at 122 Captain's Row <br /> (Map 96, Block 19) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on December 22 and December 29, 1989, a copy of which is attached hereto <br /> and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town Hall <br /> on Wednesday, January 10, 1990 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> Cheryl A. Hawver, Michael A. Makunas and William J. Hanrahan. <br /> Gregory Taylor of Taylor Design represented the Applicant. <br /> He informed the Board that Mr. Deery had owned the dock for 20 years <br /> and learned that most of his dock was not on his property. He <br /> requested permission to remove the existing pier and float and <br /> relocate it. Comments were received from the Shellfish Constable stating <br /> that he had no objections to the new location. <br /> The Board determined that the use is in harmony with the general <br /> purpose and intent of the Zoning By-laws and complies with the <br /> provisions set forth within the By-laws. The Board requested a <br /> new set of plans eliminating proposed steps. <br />
