Wall for a Variance V-90-01-06 <br /> A Petition was filed by Florence A. Wall of Mashpee, Massachusetts <br /> for a Variance under Sections 174.28A and 174.31 of the Zoning By-laws <br /> for permission to vary the setback requirements in an R-5 zoning district <br /> on property located at 146 Ninigret Avenue (Map 65, Block 79) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on January 8 and January 15, 1990, a copy of which is attached hereto <br /> and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town Hall <br /> on Wednesday, January 24, 1990 'at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> Cheryl A. Hawver, Michael A. Makunas and Richard E. Halpern. <br /> Engineer Charles D. Spohr represented the Applicant. He <br /> informed the Board that Mrs. Wall planned to built a new sundeck and <br /> an addition to the living room. The Variance was required for the <br /> setback from Sakonnet Drive. The Board requested additional information <br /> on lot coverage which Mr. Spohr submitted to the Board at a later date. <br /> The Petition for the Variance was necessary if a companion Petition <br /> for a Special Permit were granted. The Board determined that the final <br /> lot coverage percentages were excessive and denied the Special Permit <br /> and the Variance. The Board did not find that relief could be granted with- <br /> out , derogating from the intent or purpose of the zoning by-laws. <br />
