Moskowitz for a Special Permit SP-90-01-10 <br /> A Petition was filed by Michael and Beth S. Moskowitz of Needham, <br /> Massachusetts for a Special Permit under Sections 174-17 and 174.25.I.9 <br /> of the Zoning By-laws for permission to construct and maintain a <br /> stairway and connecting walkway to an existing dock, ramp and floats <br /> in an R-3 zoning district on property located at 146 Popponesset Island <br /> Road (Map 112, Block 10) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on January 8 and January 15, 1990, a copy of which is attached hereto <br /> and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, January 24, 1990 at 7:30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Cheryl A. Hawver, Michael A. Makunas and Edward M. 'Govoni. <br /> David Sanicki of Cape and Islands Surveying represented the Applicant. <br /> He informed the Board that Mr. Moskowitz had applied to the Conservation <br /> Commission for permission to relocate the existing stairway to align <br /> it with an existing dock. He stated that there had been questions at <br /> the Conservation hearing as to whether the existing float system had <br /> been altered. He informed the Board that there was a dispute with an <br /> abutter on whether the two floats may have been enlarged. Robert Sherman, <br /> Conservation Agent, said an Order of Conditions had been issued for <br /> the relocation of the stairs. Paul Somerville, Shellfish Constable, <br /> stated that the inner float sits on a shellfish bed and he would prefer <br /> to have the pier extended and to have the float further out in the water. <br />
