Viglas for a Special Permit SP-90-01-11 <br /> 1 <br /> 1 <br /> A Petition was filed by Charles J. Viglas of Winchester, <br /> tMassachusetts for a Special Permit under Section 174-25.I.9 of <br /> I the Zoning By-laws for an existing pier, ramp and floats in an <br /> R-3 zoning district on property located at 71 Frog Pond Close <br /> (Map 90, Block 51) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on January 8 and January 15, 1990, a copy of which is attached hereto <br /> and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, January 24, 1990 at 7:30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Cheryl A. Hawver, Michael A. Makunas and John J. Friel. <br /> Jeffrey Ryther of Holmes and McGrath Engineers represented the <br /> Applicant. He presented plans of a 120' long pier, ramp and float <br /> structure which had been on the property for two years. <br /> Comments were received from Robert Sherman, Conservation Agent, who <br /> stated that the structure had been installed without a filing under <br /> the Mass. Wetlands Protection Act or the Mashpee Wetlands Protection <br /> Law. The Conservation Commission had concerns about the deterioration <br /> of the bank. Paul Somerville, Shellfish Constable, stated that there <br /> was a soft shell clam resource area within 20' and he would prefer <br /> a permanent structure installed above it and that the total structure <br /> be limited to 70' . No comments were received from abutters. <br />
