MA 02649 <br /> BOARD OF 'APPEALS <br /> DECISION FOR SPECIAL PERMIT <br /> RE: Petition of Sidney Covich for a Special Permit SP-90-01-12 <br /> A Petition was filed by Sidney Covich of Waban, Massachusetts <br /> for a Special Permit under Section 174.25.I.9 of the Zoning By-laws <br /> for an existing unlicensed pier, ramp and floats in an R-3 zoning <br /> district on property located at 141 Daniel's Island Road (Map 105, <br /> Block 277) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 4OA. , Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on.January 8 and January 15, 1990, a copy of which is attached hereto <br /> and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, January 24, 1990 at 7:30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Cheryl A. Hawver, Michael A. Makunas and John J. Friel. <br /> Jeffrey Ryther of Holmes and McGrath Engineers represented the <br /> Applicant. He presented plans for an existing pier, ramp and floats. <br /> Robert Sherman, Conservation Agent, informed the Board that the pier <br /> in question was given an Enforcement Order by the Conservation Commission <br /> since there had been substantial alterations beyond the scope of the <br /> original Order of Conditions. Paul Somerville, Shellfish Constable, <br /> stated that there was a soft shell clam resource and a quohog habitat in <br /> the area and he would recommend a new design with a longer pier and <br /> a total length not to exceed 70' . No commentscwere received from . s . i <br /> abutters. <br />
