MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A VARIANCE <br /> RE: Debra Orlando for a Variance V-90-01-15 <br /> A Petition was filed by Debra Orlando of Mashpee, Massachusetts <br /> for a V ariance under Section 174-31 of the Zoning By-laws for <br /> permission to vary the side line setback in an R-3 zoning district on <br /> property located at 19 Pinecrest Avenue (Map 49, Block 161) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on January 29 and February 5, 1990, a copy of which is attached hereto <br /> and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town Hall <br /> on Wednesday, February 14, 1990 at which time the following members of <br /> the Board of Appeals were present and acting throughout: William J. <br /> Hanrahan, Michael A. Makunas and John J. Friel. <br /> Engineer Christopher Costa represented the applicant. He informed <br /> the Board that an error had been made in the pouring of a foundation <br /> resulting in placement within the required setback area. An abutter <br /> confirmed that the stakes identifying the foundation boundaries had <br /> been moved. The Board was'informed that the applicant plans to have <br /> landscaping designed to hide the foundation. <br /> The Board determined that there were circumstances relating to <br /> the structure which would cause substantial hardship if relief were <br /> not granted. The Board found that this Variance request would not <br /> derogate from the intent of the By-laws and would not be a detriment <br /> to the surrounding neighborhood. <br />
