MA 02649
BOARD OF APPEALS
DECISION
FOR A VARIANCE
RE: Debra Orlando for a Variance V-90-01-15
A Petition was filed by Debra Orlando of Mashpee, Massachusetts
for a V ariance under Section 174-31 of the Zoning By-laws for
permission to vary the side line setback in an R-3 zoning district on
property located at 19 Pinecrest Avenue (Map 49, Block 161) Mashpee, MA.
Notice was duly given to abutters in accordance with Massachusetts
General Laws Chapter 40A. Notice was given by publication in The
Enterprise, a newspaper of general circulation in the Town of Mashpee
on January 29 and February 5, 1990, a copy of which is attached hereto
and made a part hereof.
A public hearing was held on the Petition at the Mashpee Town Hall
on Wednesday, February 14, 1990 at which time the following members of
the Board of Appeals were present and acting throughout: William J.
Hanrahan, Michael A. Makunas and John J. Friel.
Engineer Christopher Costa represented the applicant. He informed
the Board that an error had been made in the pouring of a foundation
resulting in placement within the required setback area. An abutter
confirmed that the stakes identifying the foundation boundaries had
been moved. The Board was'informed that the applicant plans to have
landscaping designed to hide the foundation.
The Board determined that there were circumstances relating to
the structure which would cause substantial hardship if relief were
not granted. The Board found that this Variance request would not
derogate from the intent of the By-laws and would not be a detriment
to the surrounding neighborhood.
